Civil and Criminal Trial Process

INSTRUCTIONS:
1.Please read these instructions closely. This will allow you to earn the maximum number of grading points.
For IA and other non-paralegal majors: Your assignment must follow APA (http://apastyle.org (Links to an external site.)) formatting guidelines. This means you must include an APA formatting title page with your assignment, as well as a separate APA formatted References page. You should NOT include an abstract with this assignment (as abstracts are for papers that will be published.) In addition, your margins should be 1” all around.
You are encouraged to use the APA template that is available in Document Sharing for Unit 1, and/or in the Course Information tab.
Also, remember if you are using APA, that you only include sources in your references, if you have a corresponding text cite to the source. Please use Times New Roman font style, double spaced, 12 point font, with 1 inch margins (top, bottom, right, left), and the first line of each paragraph indented 1/2 inch.
For paralegal majors ONLY: You will write your assignment in a legal memo format addressed to your instructor. All citations must follow the Michigan Appellate Opinion Manual (http://courts.mi.gov/Courts/MichiganSupremeCourt/Documents/MiAppOpManual.pdf (Links to an external site.)).

FOR EVERYONE (ALL STUDENTS/ALL MAJORS/EVERYONE IN CLASS):
2.Your assignment must be 1250-1500 words in length. Papers less than 1250 words will have significant point deductions made and/or little or no points awarded, and papers of that length will have difficulty responding with the appropriate depth and discussion of the topics.
3.Your response to the Assignment problem should be scholarly and based on primary legal authority. I think or I believe responses that are based on personal opinion are not appropriate. Secondary legal authorities such as legal journals and law reviews can be used only if there is no appropriate legal primary authority. Secondary authority can also be used as a finding tool to help you locate primary authority. Again, when you are answering the question presented, you must take the case facts, locate your authority, apply the authority to the facts, and then make a conclusion.
 4. Use this ranking of primary authority in your answers (as follows, in order):
US Constitution; US Statutes; US Cases; Federal agency rules, regulations and orders; state Constitutions; state statutes, state cases; state agency rules; regulations and orders; local ordinances; and state Attorney General opinions.
 5. Your writing should be reflective of an upper-level university student. You must incorporate the best business writing practices in your work. I look for responses that are logical and well written. In other words, you are presenting a business argument to discuss legal compliance. This also means you should also closely proofread your work for writing errors prior to submitting your work.
 6. I expect to see a minimum of three appropriate legal primary authority/references for the assignment. If you are using APA, remember that you only include sources in your references if it has a corresponding text citation. For this assignment, it is possible that your sources will include the websites for the vendors that you chose, in addition to the three or more primary legal references.  Papers lacking at least three legal primary authorities/references will have a significant point reduction.
7. You will need a separate paragraph and a complete discussion of all of the issues involved, all of the legal concerns, including a Constitutional analysis (where applicable), federal and state law(s) that are applicable and how they apply, and any case law that is relevant that needs to be discussed.  Broad, generic, conclusory statements without specific legal citation or support will not earn points.  You need to support your statements/conclusions with legal analysis, discussion, and then conclude, all with appropriate citation to the various laws, Constitutional provisions, etc.
 8. Use this format and naming convention for your assignment file:
yourlastname_ass7_LEGL320
 9. This assignment is due at the end of the Module (Unit) at 11:57 p.m. Ypsilanti, Michigan time. **THERE ARE NO LATE ASSIGNMENTS ACCEPTED FOR MODULE 7.  Please refer to the Course Calendar for the specific due date. **Note that Canvass will often NOT accept a submission at 11:59 PM when it shows a deadline of 11:59 PM.  Therefore, your actual deadline is 11:57 PM.  Please do not wait to submit anything later than that as Canvass may not accept it and it will not be accepted in this course.**  Please note the earlier due date.

Optional Assignment 7:
Prepare a well written, well-researched paper on the relatively new Michigan discovery rules.  I am looking for a paper that details all of the new changes that were new to Michigan in January 2020.  In addition to describing, in detail, the changes, I also then want and analysis section that speaks to why these changes are important, and what impact they will likely have, as well as analysis and discussion as to what benefits the system will see from them, as well as the potential drawbacks to the changes.  Please take note of the length requirements above.
